James Craney prevailed on a motion to dismiss brought in the City of St. Louis, Circuit Court. Plaintiff’s petition alleged property damage resulting from construction defect. The motion to dismiss brought by CLG argued that the allegations were barred under the doctrine of claim preclusion, based upon a prior petition that the plaintiff had filed on a pro-se basis. The court agreed, and the matter was dismissed with prejudice.
